People v. Wade

Appellate Division of the Supreme Court of New York, Second Department
May 22, 1967
28 A.D.2d 565 (N.Y. App. Div. 1967)

Opinion

May 22, 1967

Order of the County Court, Nassau County, dated March 31, 1966 and entered April 4, 1966, affirmed. No opinion. Appeal from the order of the County Court, Nassau County, dated June 21, 1966 and entered June 22, 1966, severed and ordered on the calendar for the September Term for reargument. Appellant's brief must be served and filed on or before August 10, 1967 and respondent's brief must be served and filed on or before August 31, 1967. This court's examination of the original papers disclosed that the merits of an order dated December 2, 1965 were erroneously briefed in place of those of the order dated June 21, 1966, which order deals with a different claim and subject matter. The June 21, 1966 order is before us and its merits should be considered and briefed by the parties before the court passes on the merits. Christ, Acting P.J., Rabin, Hopkins, Benjamin and Munder, JJ., concur.
