In light of the opinion of the Court of Appeals issued December 2, 1997, the application for leave to appeal is denied because the Supreme Court is not persuaded that the questions presented should be reviewed. See ante at 855.

CAVANAGH and KELLY, JJ.

We would remand this case to the Court of Appeals for further consideration of the stricken issues as part of the defendant's appeal of right. By appealing the waiver decision to the circuit court, the defendant preserved the waiver issues for subsequent appeal to the Court of Appeals and to this Court. We further would order that the Court of Appeals reconsider the defendant's motion to remand and to file a supplemental brief.
