DECISION AND ORDER ON MOTION

Application to change attorney and to relieve John R. Trice, Esq., as assigned counsel.

Upon the papers filed in support of the application, and no papers having been filed in opposition thereto, it is

ORDERED that assigned counsel is relieved from any further obligation to represent appellant on this appeal and that Marissa Tuohy, Esq. be substituted as retained counsel, and it is further

ORDERED that appellant's poor person status is continued, and it is further

ORDERED that assigned counsel shall deliver to appellant's retained counsel, Marisssa Tuohy, Esq., Ostrer & Associates P.C., 111 Main Street, P.O. Box 509, Chester, NY 10918, (845) 469-7577, any and all transcripts, documents and other items in his possession relative to this appeal.
