THE PEOPLE OF THE STATE OF NEW YORK, RESPONDENT, v. JAMES M. VERNOOY, DEFENDANT-APPELLANT.


PRESENT:

Defendant having moved to extend the time to file and serve reply papers with respect to the application pursuant to CPL 460.15 seeking permission to appeal from an order of Ontario County Court, entered July 26, 2016,

Now, upon reading and filing the affidavit of James M. Vernooy sworn to October 11, 2016, the notice of motion with proof of service thereof, and due deliberation having been had thereon,

It is hereby ORDERED that the motion is granted to the extent that the Clerk's Office is directed to accept the affidavit of James M. Vernooy entitled reply to People's opposition sworn to October 11, 2016 and submitted to this Court on October 17, 2016 for filing.
