THE PEOPLE OF THE STATE OF NEW YORK, RESPONDENT, v. ANDRE VERNON, DEFENDANT-APPELLANT.


PRESENT:

Appellant having moved for permission to proceed as a poor person on the appeal taken from an order of the Erie County Court dated January 24, 2011, and for other relief,

Now, upon reading and filing the affirmation of Michael L. D'Amico, Esq. dated May 26, 2015, the affidavit of Andre Vernon sworn to April 17, 2015, the notice of motion with proof of due service thereof, the statement of Donna A. Milling, Esq. dated June 24, 2015, and due deliberation having been had thereon,

It is hereby ORDERED that the motion is granted to the extent that the appeal herein may be prosecuted upon one record as defined by 22 NYCRR 1000.3 (c) (1) and ten copies of appellant's brief, reproduced in accordance with 22 NYCRR 1000.4 (f), and

It is further ORDERED that the Clerk of the County of Erie is hereby directed to provide Michael L. D'Amico, Esq. with copies of all papers and transcripts of stenographic or audio taped minutes, if any, of the proceedings upon which the appeal is based, and

It is further ORDERED that the motion is granted to the extent that the ordering paragraph of the order of this Court entered April 16, 2015 is hereby amended by striking therefrom the date July 15, 2015 and inserting in place thereof the date October 13, 2015.
