On order of the Court, the application for leave to appeal the September 14, 2015 order of the Court of Appeals is considered and, pursuant to MCR 7.305(H)(1), in lieu of granting leave to appeal, we REMAND this case to the Court of Appeals for plenary consideration of the first of two claims of error that were raised in the defendant's delayed application for leave to appeal filed in the Court of Appeals on July 22, 2015, namely, whether the scoring of Offense Variable 14 was supported by a preponderance of the evidence. See People v Hardy, 494 Mich 430, 438 (2013).
I, Larry S. Royster, Clerk of the Michigan Supreme Court, certify that the foregoing is a true and complete copy of the order entered at the direction of the Court.
