The above-captioned matter is transferred to the Court of Appeal, Fourth Appellate District, Division Two, with directions to vacate its decision and reconsider the cause in light of People v. Tirado (2022) 12 Cal.5th 688 and People v. Lemcke (2021) 11 Cal.5th 644. (Cal. Rules of Court, rule 8.528(d).)
