California Rules of Court, rule 8.1115(a), prohibits courts and parties from citing or relying on opinions not certified for publication or ordered published, except as specified by rule 8.1115(b). This opinion has not been certified for publication or ordered published for purposes of rule 8.1115. (Super. Ct. No. 2018025116)
(Ventura County)

Santos Daniel Velasquez appeals his conviction, by jury, of one count of first degree residential burglary. (Pen. Code, § 459.) The trial court initially suspended imposition of sentence and granted probation on the condition, among others, that appellant participate in behavioral health treatment, and waived all fines and fees.

We appointed counsel to represent appellant on this appeal. After counsel's examination of the record, counsel filed an opening brief in which no issues were raised. On December 16, 2019, we advised appellant that he had 30 days within which to personally submit any contentions or issues he wished us to consider. No response has been received.

The record reflects that, in July 2018, a contractor was meeting with other workers on a home repair project when he heard an alarm go off at a nearby house. Investigating, the contractor saw appellant rummaging through drawers in that house. He convinced appellant to come outside where the contractor and other workers detained appellant until police arrived. A jury convicted appellant of burglarizing the home.

The trial court suspended imposition of sentence, granted probation and imposed various fines and fees. Appellant filed a motion to correct the fines and fees imposed based on People v. Dueñas (2019) 30 Cal.App.5th 1157 and his inability to pay. The trial court granted the motion and waived all fines and fees.

We have reviewed the entire record and are satisfied that appellant's counsel has fully complied with her responsibilities and that no arguable issues exist. (People v. Wende (1979) 25 Cal.3d 436, 443; People v. Kelly (2006) 40 Cal.4th 106, 126.)

The judgment is affirmed.
