People of Michigan v. Jerry Rick Vandiver

LC No. 92-500047-01-FC

Deborah A. Servitto, Douglas B. Shapiro Judges

ORDER

MARK J. CAVANAGH PRESIDING JUDGE

The motion for reconsideration is DENIED. The six-mo nth period to seek delayed leave to appeal in this Court, see MCR 7.205(A)(4), had expired by the time defendant mailed documents to this Court in February 2022, attempting to toll the filing deadline under AO 2022-2. The mail disbursement form provided to this Court in response to this Court's May 20, 2022 correspondence is clearly a forgery; it is a copy of the same document provided as Exhibit 4 to defendant's motion for reconsideration, but with the submission and mailing dates altered. Because defendant failed to toll the filing deadline before his six-month period to seek delayed leave to appeal expired, this Court lacks jurisdiction.
