Defendant having moved to take an appeal as a right from an order of the Erie County Court, dated September 23, 2016,

Now, upon reading and filing the statement of Wayne P. Vance dated March 26, 2017 and affidavit of Wayne P. Vance sworn to March 3, 2017, the notice of motion with proof of service thereof, and due deliberation having been had thereon,

It is hereby ORDERED that the motion is dismissed.
