Opinion
December 20, 1961
Appeal by defendant: (1) from a judgment of the County Court, Nassau County, rendered August 5, 1959, after a jury trial, convicting him of burglary in the third degree, and sentencing him, as a prior felony offender, to serve a term of 5 to 10 years, and (b) from every intermediate order made in the action. Execution of the sentence was suspended but defendant was returned to Elmira Reformatory as a parole violator. Judgment affirmed. No opinion. No separate appeal lies from the intermediate orders, which have been reviewed on the appeal from the judgment of conviction. Nolan, P.J., Ughetta, Christ, Pette and Brennan, JJ. concur.
