Defendant having moved pursuant to CPL 460.10(6) to extend the time to serve a notice of appeal from a judgment of Supreme Court, Onondaga County, rendered March 9, 2017,

Now, upon reading and filing the affidavit of Jamie Urrutia sworn to August 30, 2017, the notice of motion with proof of service thereof, the statement of James P. Maxwell, Esq. dated October 4, 2017, and due deliberation having been had thereon,
