By order of April 9, 2002, the delayed application for leave to appeal from the July 18, 2001 decision of the Court of Appeals was considered and, pursuant to MCR 7.302(F)(1), in lieu of granting leave to appeal, the matter was remanded to the Oceana Circuit Court for further explanation of the circuit court's January 30, 2001 order granting appointed defense counsel David Grunst's motion to withdraw.

Attorney Grunst having filed an affidavit as directed by the circuit court, the defendant having filed a response in opposition and the circuit court having filed its findings of facts and conclusions of law with the clerk of this Court, the delayed application for leave to appeal from the July 18, 2001 decision of the Court of Appeals is again considered, and it is DENIED because we are not persuaded that the questions presented should be reviewed by this Court.

Kelly, J., would remand this matter to the trial court for appointment of new appellate counsel to pursue an appeal on the defendant's behalf.
