On order of the Court, the delayed application for leave to appeal from the October 23, 1998 decision of the Court of Appeals is considered and, in lieu of granting leave to appeal, we VACATE the judgment of the Oceana Circuit Court and REMAND this case to that court for resentencing. If the court is unable, in its discretion, to sentence defendant within the sentence recommendation of 120 to 300 months or life, the court shall offer defendant the opportunity to withdraw his plea. People v Killebrew, 416 Mich. 189 (1982).

We do not retain jurisdiction.
