Order
On order of the Court, the application for leave to appeal the January 3, 2019 judgment of the Court of Appeals is considered. We DIRECT the Eaton County Prosecuting Attorney to answer the application for leave to appeal within 28 days after the date of this order. In particular, the prosecuting attorney shall address whether the defendant is entitled to a new trial by the decisions in People v. Thorpe , 504 Mich. ––––, ––– N.W.2d ––––, 2019 WL 3059550 (2019) (Docket No. 156777) ; People v. Harbison , 504 Mich. ––––, 914 N.W.2d 914 (2019) ; and People v. Shaw , 315 Mich.App. 668, 892 N.W.2d 15 (2016).
The application for leave to appeal remains pending.
