PRESENT: , P.J., SMITH, CENTRA, FAHEY, AND PERADOTTO, JJ.

Counsel for appellant having moved for permission to withdraw as assigned counsel on the appeals taken from the order of the Onondaga County Court, rendered December 9, 2009, on the ground that the appellant has abandoned the appeals,

Now, upon reading and filing the affirmation of Philip Rothschild, Esq. dated November 8, 2012, the notice of motion with proof of service thereof, and due deliberation having been had thereon,

It is hereby ORDERED that the motion is granted to the extent that Gerald Barth, Esq. is relieved of his assignment, and

It is further ORDERED that the appellant perfect the appeals on or before February 25, 2013, and in the event of failure to so perfect, the appeals are hereby dismissed without further order.
