ORDER
The "motion to extend time for filing transcripts and to enlarge time for filing brief on appeal" is GRANTED to the extent that, on or before August 1, 2023, court reporter Shellie R. Sanders (CER 7667) shall file the complete transcripts for this appeal with the trial court and shall file a notice of filing transcripts with this Court. If Shellie R. Sanders (CER 7667) does not comply with the August 1, 2023 deadline set forth in this order, she shall show cause in writing by August 4, 2023, why the complete transcripts have not been filed, and to further explain why she is not in contempt of this Court for failing to comply with this Court's orders.
The motion is DENIED to the extent that defendant-appellant is requesting an extension of time to file appellant's brief. The time for filing appellant's brief does not start to run until the transcripts are filed in the trial court. MCR 7.212(A)(1)(a)(iii).
Further, on its own motion, pursuant to MCR 7.210(B)(3)(f), this Court orders that court reporter Shellie R. Sanders (CER 7667) is ASSESSED COSTS of $100 as a sanction for her failure to file the transcripts in this appeal in a timely manner. The transcripts were originally due on May 15, 2023, and this Court's June 28, 2023 and July 5, 2023 orders provided Sanders with an extension to July 5, 2023. The $100 in assessed costs shall be paid to the Clerk of the Court within 21 days of the Clerk's certification of this order.
A copy of this order shall be furnished to the Fourth Judicial Circuit Court Chief Judge and the State Court Administrative Office.
