The petition for review is denied without prejudice to the filing of a petition for a writ of habeas corpus alleging ineffective assistance of appellate counsel. Attorney Mark McBride, State Bar No. 226684, is hereby referred to the State Bar of California to investigate whether he was engaged in the unauthorized practice of law during the periods of time that counsel was suspended from the active practice of law through the pendency of this appeal.
