ORDER

The prosecutor's confession of error pursuant to MCR 7.211(C)(7) is APPROVED because, at defendant's sentencing, the trial court used an incorrect standard when deciding not to downwardly depart from the sentencing guidelines range.

The June 7, 2023 judgment of sentence is VACATED, and the matter is REMANDED to the trial court for resentencing.

This Court does not retain jurisdiction.
