BENDISH, ESQ., and NICHOLAS MASELLI, ESQ., counsel for the respondents and due deliberation having been had thereon; it is hereby,

ORDERED AND ADJUDGED that on the court's own motion the appeals are consolidated for purposes of disposition; it is further,

ORDERED AND ADJUDGED that the appeals from the order dated August 11, 2003 are unanimously dismissed as superseded; it is further,

ORDERED AND ADJUDGED that the order dated September 30, 2003 is unanimously affirmed.
