DECISION & ORDER ON MOTION

Motion by the appellant pro se on for leave to prosecute an appeal from a judgment of the Supreme Court, Queens County, rendered February 2, 2011, as a poor person, and for the assignment of counsel.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the motion is denied without prejudice to renew if the appellant discharges his retained counsel or retained counsel makes a motion to withdraw as counsel for the appellant.
