Appellate Division of the Supreme Court of New York, Second Department
Nov 4, 2009
67 A.D.3d 714 (N.Y. App. Div. 2009)

Opinion

No. 2008-04131.

November 4, 2009.

Appeal by the defendant from a judgment of the Supreme Court, Nassau County (Donnino, J.), rendered March 19, 2008, convicting him of attempted burglary in the second degree, upon his plea of guilty, and imposing sentence.

Arza Feldman, Uniondale, N.Y., for appellant.

Kathleen M. Rice, District Attorney, Mineola, N.Y. (Andrew Fukuda and Matthew C. Frankel of counsel), for respondent.

Before: Rivera, J.P., Miller, Balkin, Leventhal and Hall, JJ., concur.

Ordered that the judgment is affirmed.

We have reviewed the record and agree with the defendant's assigned counsel that there are no nonfrivolous issues which could be raised on appeal. Counsel's application for leave to withdraw as counsel is granted ( see Anders v California; 386 US 738; People v Paige, 54 AD2d 631; cf. People v Gonzalez, 47 NY2d 606).
