On February 20, 2001, Bulmario Torres was sentenced to prison after conviction. The record does not reveal the nature or date of defendant’s offense, whether it resulted from a plea of guilty or no contest, or whether he appealed. A reference in the trial court’s minute order denying the motion that is the subject of this appeal indicates that defendant was sentenced to 39 years 4 months in prison.
On March 26, 2010, defendant filed a motion in the trial court challenging the imposition of a restitution fine (Pen. Code, § 1202.4, subd. (b)) of $5,000. (The motion is not part of the appellate record.) The trial court denied the motion as untimely and unmeritorious the same day it was filed, and defendant appealed.
After an examination of the record, counsel filed an opening brief raising no issues and asking this court to independently review the record. On December 29, 2010, we advised defendant he had 30 days within which to personally submit any contentions or issues he wished us to consider. To date, we have received no response.
We have examined the entire record and are satisfied that defendant’s attorney has fully complied with her responsibilities and that no arguable issues exist. (People v. Kelly (2006) 40 Cal.4th 106, 109–110; People v. Wende (1979) 25 Cal.3d 436, 441.)
DISPOSITION
The order is affirmed.
