People v. Tobias

Appellate Division of the Supreme Court of New York, Third Department
Jul 8, 1993
195 A.D.2d 700 (N.Y. App. Div. 1993)

Opinion

July 8, 1993

Appeal from the County Court of Sullivan County (Ceresia, Jr., J.).

Upon reviewing the record and brief submitted by defense counsel, we agree that there are no nonfrivolous issues that could be raised on appeal. Consequently, the judgment should be affirmed and defense counsel's application for leave to withdraw granted (see, Anders v. California, 386 U.S. 738; People v. Creeden, 150 A.D.2d 887).

Mikoll, J.P., Yesawich, Jr., Levine, Crew III and Casey, JJ., concur. Ordered that the judgment is affirmed, and application to be relieved of assignment granted.
