Opinion
March 7, 1949.
Judgment of the Court of Special Sessions of the City of New York, Borough of Brooklyn, convicting defendant of the crime of book-making, affirmed. No opinion. Carswell, Acting P.J., Wenzel and MacCrate, JJ., concur; Johnston and Adel, JJ., dissent and vote to reverse the judgment and to dismiss the information on the ground that the proof failed to establish defendant's guilt beyond a reasonable doubt. ( People v. Goldstein, 295 N.Y. 61, 65.)
