ORDER

On order of the Court, the application for leave to appeal the August 17, 2021 order of the Court of Appeals is considered. We DIRECT the Livingston County Prosecuting Attorney to answer the application for leave to appeal within 28 days after the date of this order, addressing only the defendant's argument that the judgment of sentence incorrectly asserts that the defendant pleaded guilty to MCL 333.7401(2)(a)(iii) as a second offense under MCL 333.7413(2)(a).

The application for leave to appeal remains pending.
