ORDER

The motion to waive fees is GRANTED for this case only.

The motion to amend the delayed application is GRANTED and the proposed amendment received with that motion is accepted for filing.

As amended, the delayed application for leave to appeal is DENIED because defendant has failed to establish that the trial court committed any error warranting reversal in denying the motion for relief from judgment. Although the trial court erred insofar as it relied on MCR 6.508(D)(2) as a basis for denying relief from judgment here, its error in that regard was harmless because it nevertheless reached the correct result in its alternate analysis under MCR 6.508(D)(3).
