Defendant having moved pursuant to CPL 460.30 to extend the time to take an appeal from a judgment of the Supreme Court, Erie County rendered December 22, 2010,

Now, upon reading and filing the affidavits of Anthony Thomas sworn to December 5, 2011, January 4, 2012, and January 23, 2012, the notice of motion with proof of service thereof, the statements of Anthony Thomas dated January 10, 2012 and January 20, 2012, the statement of Donna A. Milling, Esq. dated January 11, 2012, and the affirmation of Paul G. Dell dated January 16, 2012, and due deliberation having been had thereon,

It is hereby ORDERED that the motion is granted, and Anthony Thomas is hereby directed to file and serve the notice of appeal in accordance with CPL 460.10 on or before March 2, 2012.
