People v. Thomas

Appellate Division of the Supreme Court of New York, First Department
Dec 15, 1998
256 A.D.2d 156 (N.Y. App. Div. 1998)

Opinion

December 15, 1998

Appeal from the Supreme Court, New York County (Michael Obus, J.).

The evidence was legally sufficient to disprove the justification defense and the verdict was not against the weight of the evidence. Issues of credibility were properly presented to the jury and we see no reason to disturb its findings.

Concur — Ellerin, J. P., Nardelli, Rubin and Saxe, JJ.
