THE PEOPLE, Plaintiff and Respondent, v. LUIS MANUEL TEJEDA, Defendant and Appellant.
NOT TO BE PUBLISHED
A jury found Luis Manuel Tejeda guilty of assault with a deadly weapon (Pen. Code, § 245, subd. (a)(1)) with personal infliction of great bodily injury (§§ 12022.7, subd. (a), 1192.7, subd. (c)(8)) and personal use of a knife (§ 1192.7, subd. (c)(23)). In a bifurcated proceeding, he admitted serving five prior prison terms (§§ 667.5, subd. (b), 668). The court sentenced him to 11 years in prison: the three-year middle term for assault with a deadly weapon; three years for the section 12022.7, subdivision (a) enhancement; and one year for each prior. Tejeda appeals. We affirm.
BACKGROUND
On December 9, 2006, Tejeda and Matthew Weide were working as carpet installers at an El Cajon motel. Tejeda stabbed Weide in the abdomen with a knife. The police found a bloody pocket knife in Tejedas possession. There was blood on his hands and one of his fingers was cut. Weide was taken to the hospital where he underwent surgery. He required 65 to 85 sutures. Tejeda testified he stabbed Weide in self-defense.
DISCUSSION
Appointed appellate counsel has filed a brief summarizing the facts and proceedings below. Counsel presents no argument for reversal, but asks this court to review the record for error as mandated by People v. Wende (1979) 25 Cal.3d 436. Pursuant to Anders v. California (1967) 386 U.S. 738, counsel lists, as a possible but not arguable issue, whether the record established that Tejedas admission of the prison priors was knowing and voluntary.
We granted Tejeda permission to file a brief on his own behalf. He has not responded. A review of the record pursuant to People v. Wende, supra, 25 Cal.3d 436, including the possible issue listed pursuant to Anders v. California, supra, 386 U.S. 738, has disclosed no reasonably arguable appellate issue. Tejeda has been competently represented by counsel on this appeal.
DISPOSITION
The judgment is affirmed.
