ORDER

On order of the Court, we VACATE our July 19, 2024 order. The application for leave to appeal the October 5, 2023 judgment of the Court of Appeals is again considered. We direct the Clerk to schedule oral argument on the application. MCR 7.305(H)(1). The parties shall file supplemental briefs in accordance with MCR 7.312(E), addressing: (1) whether this Court's holding in People v Parks, 510 Mich. 225 (2022), should be extended to defendants who are 20 years of age at the time they commit a crime and are sentenced to mandatory life without parole, see Const 1963, art 1, § 16; and (2) whether it is necessary to overrule People v Hall, 396 Mich. 650 (1976), in order to extend Parks to defendants who were 20 years of age and, if so, whether we should overrule it.

We further direct the Clerk to schedule the oral argument in this case for the same future session of the Court when it will hear oral argument in People v Czarnecki (Docket No. 166654) and People v Poole (Docket No. 166813). The appellant's brief and appendix must be filed no later than November 22, 2024, and the appellee's brief and a separate appendix (if any) must be filed no later than December 13, 2024. The appellant may file a reply brief no later than December 30, 2024. Motions or stipulations to extend the time for the filing of briefs will not be considered.

Amici who appeared at the application stage are invited to file supplemental briefs amicus curiae. The briefs amicus curiae filed in People v Bouie (Docket No. 166232) will be considered in this case, although amici who filed in Bouie may also file supplemental briefs in this case. The Prosecuting Attorneys Association of Michigan and the Criminal Defense Attorneys of Michigan are invited to file briefs amicus curiae. Other persons or groups interested in the determination of the issues presented in this case may move the Court for permission to file briefs amicus curiae. Amicus briefs shall be filed no later than December 30, 2024.
