Defendant having moved pursuant to CPL 460.10 (6) to extend the time to serve a notice of appeal from an judgment of the Supreme Court, Monroe County, entered March 27, 2017,

Now, upon reading and filing the affirmation of Matthew D. Nafus, Esq., dated January 22, 2019, the notice of motion with proof of service thereof, and due deliberation having been had thereon,

It is hereby ORDERED that the motion is granted to the extent that the notice of appeal dated March 30, 2017, which as served upon the Monroe County District Attorney's Office on May 8, 2017, is hereby deemed timely served.
