People v. Taylor

Supreme Court of Michigan
Jun 29, 1999
598 N.W.2d 345 (Mich. 1999)

Opinion

No. 113384.

June 29, 1999.

On order of the Court, the application for leave to appeal the October 6, 1998 decision of the Court of Appeals is considered, and, pursuant to MCR 7.302(F)(1), in lieu of granting leave to appeal, we REVERSE the order of the Court of Appeals and REMAND for consideration of the merits of the application. For purposes of the 12 month deadline, defendant's application was due in the Court of Appeals on April 11, 1998. Because April 11, 1998 fell on a Saturday, the receipt of the application on April 13, 1998, a Monday, was timely. MCR 1.108(1). The supplemental application for leave to appeal, motion to add newly discovered issues, motion for appointment of counsel and motion for remand are considered and they are DENIED.

Corrigan, J., not participating.
