PRESENT:

Respondent having moved to dismiss the appeals taken from judgments of the Supreme Court, Erie County, rendered August 13, 2014, on the ground that appellant has failed to perfect timely the appeals, and appellant having moved pursuant to CPL 460.30 to extend the time to take the appeals from the judgments of Supreme Court, Erie County, rendered August 13, 2014,

Now, upon reading and filing the affidavit of Donna A. Milling, Esq. sworn to July 19, 2017, the notices of motion with proof of service thereof, the statement of Michael J. Stachowski, Esq. dated July 25, 2017, the affidavit of David H. Tait sworn to July 25, 2017, and due deliberation having been had thereon,

It is hereby ORDERED that the motion seeking to dismiss said appeals is denied, and

It is further ORDERED that the motion seeking an extension of time pursuant to CPL 460.30 is dismissed as unnecessary.
