Oct 7, 1992
186 A.D.2d 1042 (N.Y. App. Div. 1992)

Opinion

October 7, 1992

Appeal from the Niagara County Court, DiFlorio, J.

Present — Callahan, J.P., Boomer, Pine, Boehm and Doerr, JJ.

Judgment unanimously affirmed. Memorandum: The suppression court correctly concluded that the questioning of defendant by Investigator Clark was noncustodial and that defendant's statement was voluntary (see, People v Centano, 76 N.Y.2d 837, 838). Thus, defendant's statement was properly admitted at trial.
