Attorney Regulation

The Presiding Disciplinary Judge approved a Conditional Admission of Misconduct submitted by the parties and suspended Stephen H. Swift (Attorney Registration No. 14766) from the practice of law for a period of sixty days, all stayed upon the successful completion of a one-year period of probation with conditions, effective July 21, 2008. Respondent knowingly entered into a business transaction with his clients and failed to obtain his clients' consent to a joint representation after consultation for the transaction. Respondent caused potential injury by inducing his clients to enter into a financial transaction without the full benefit of independent legal counsel. His misconduct constituted grounds for the imposition of discipline pursuant to C.R.C.P. 251.5 and violated Colo. RPC 1.7(a) and 1.8(a).
