DECISION AND ORDER ON MOTION

Motion to dismiss appeal or, in the alternative, for further relief.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the motion to dismiss the appeal for failure of prosecution is denied, without costs, and the appeal is deemed timely perfected, and it is further

ORDERED that the motion to dismiss the appeal as moot is denied, without costs, and without prejudice to the issue being raised upon argument of the appeal, and it is further

ORDERED that motion for further relief is granted, without costs, to the extent that the time to file and serve the brief of respondents is extended to May 29, 2018.
