On order of the Court, the application for leave to appeal from the November 6, 1998, decision of the Court of Appeals is considered, and it is DENIED, because we are not persuaded that the question presented should be reviewed by this Court, but this is without prejudice to the defendant's option of bringing a motion for relief from judgment and developing a reviewable record as was done in People v Lester, 232 Mich. App. 262; 591 N.W.2d 267 (1998).

Markman, J., not participating.
