People of Michigan v. Randy Scott Stevens

LC No. 13-003860-FC

James Robert Redford, Christopher P. Yates Judges

ORDER

Mark T. Boonstra, Presiding Judge

The motion to expand the record is DENIED.

The motion to remand is DENIED.

The delayed application for leave to appeal is DENIED because defendant has failed to establish that the trial court erred in denying the successive motion for relief from judgment. Because the alleged "new scientific evidence" was never presented to the trial court, it was not considered by the Court. This order does not preclude defendant from filing another successive motion for relief from judgment on a claim that the alleged "new scientific evidence" is "evidence that was not discovered before the first" motion for relief from judgment. MCR 6.502(G)(2).
