People of Michigan v. Frederick Stampone

LC No. 20-006877-FC

ORDER

Elizabeth L. Gleicher, Chief Judge, acting under MCR 7.203(F)(1), orders;

The motion to waive fees is GRANTED for this appeal only.

The claim of appeal is DISMISSED for lack of jurisdiction because the August 15, 2022 judgment of sentence, which was based upon a plea of guilty or no contest to a crime committed after December 27, 1994, is not appealable as a matter of right. MCR 7.203(A)(1)(b). Dismissal is without prejudice to the filing of an application for leave to appeal under MCR 7.205(A)(4), provided such a filing meets all requirements under the court rules and is not time-barred. Moreover, on August 25, 2022, the trial court entered an order appointing J. Nicholas Bostic (P40653) as defendant's appellate counsel.
