Before Ardaiz, P.J., Gomes, J. and Dawson, J.

Pursuant to the response filed by the Attorney General on February 19, 2009, this court’s order filed on February 20, 2009, and the fact appellant did not file a reply, this court deems appellant to be in “agreement” the appeal in the above entitled action be dismissed.

The appeal in the above entitled action is therefore dismissed.

Appellant’s request for appointment of counsel is denied.
