It is ordered that the opinion filed herein on July 28, 2009, be modified as follows:

On page 5, first full paragraph, lines 8-9, “was not addressing appellant” is deleted and the following is inserted in its place:

did not intend to address appellant. On that date, he was released to a representative of a residential drug treatment program and was not sentenced.

This modification does not change the judgment.

The petition for rehearing is denied.
