The above named appellant having appealed to this court from a Judgment of Conviction of the Justice Court, Town of Poughkeepsie, Dutchess County rendered on January 3, 2006 and the said appeal having been submitted by Yasmin Daley Duncan, Esq., counsel for the appellant and no brief having been submitted for the respondent and due deliberation having been had thereon; it is hereby,

Ordered and Adjudged that the judgment of conviction is reversed on the law, the felony complaint is reinstated and the matter is remanded to the court below for all further proceedings upon the felony complaint.
