The PEOPLE, etc., respondent, v. Bobby SOOKNANAN, appellant.

Lynn W.L. Fahey, New York, N.Y. (Leila Hull of counsel), for appellant. *468 Richard A. Brown, District Attorney, Kew Gardens, N.Y. (John M. Castellano, Nicoletta J. Caferri, and William H. Branigan of counsel), for respondent.

Lynn W.L. Fahey, New York, N.Y. (Leila Hull of counsel), for appellant. *468 Richard A. Brown, District Attorney, Kew Gardens, N.Y. (John M. Castellano, Nicoletta J. Caferri, and William H. Branigan of counsel), for respondent.

Appeal by the defendant from a judgment of the Supreme Court, Queens County (Blumenfeld, J.), rendered June 23, 2010, convicting him of criminal possession of a weapon in the third degree, after a nonjury trial, and imposing sentence.

ORDERED that the judgment is affirmed.

Viewing the evidence in the light most favorable to the People ( see People v. Contes, 60 N.Y.2d 620, 467 N.Y.S.2d 349, 454 N.E.2d 932), we find that it was legally sufficient to establish the defendant's guilt beyond a reasonable doubt of criminal possession of a weapon in the third degree. Moreover, upon our independent review pursuant to CPL 470.15(5), we are satisfied that the verdict of guilt was not against the weight of the evidence ( see People v. Romero, 7 N.Y.3d 633, 826 N.Y.S.2d 163, 859 N.E.2d 902). Contrary to the defendant's contention, his conduct was not consistent with innocent possession ( see generally People v. Williams, 50 N.Y.2d 1043, 1045, 431 N.Y.S.2d 698, 409 N.E.2d 1372; accord. People v. Snyder, 73 N.Y.2d 900, 902, 539 N.Y.S.2d 285, 536 N.E.2d 614; People v. Hawkins, 258 A.D.2d 472, 685 N.Y.S.2d 253; People v. Ortiz, 172 A.D.2d 696, 568 N.Y.S.2d 829).

DILLON, J.P., FLORIO, CHAMBERS and ROMAN, JJ., concur.
