DECISION & ORDER ON MOTION

Motion by the respondent to hold in abeyance an appeal from a judgment of the Supreme Court, Queens County, rendered May 21, 2009, or to enlarge the time to serve and file a brief .

Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is

ORDERED that the motion is granted to the extent that the respondent's time to serve and file a brief is enlarged until 30 days after the Supreme Court, Queens County, determines the respondent's motion to resettle the trial transcript, and the respondent shall notify this Court expeditiously after the motion is determined, and the motion, inter alia, to hold the appeal in abeyance is otherwise denied.
