60 A.D.3d 1093 (N.Y. App. Div. 2009)

Opinion

No. 2007-11342.

March 31, 2009.

Appeal by the defendant from a judgment of the County Court, Orange County (DeRosa, J.), rendered December 6, 2007, convicting him of assault in the second degree, upon his plea of guilty, and imposing sentence.

Francis D. Phillips II, District Attorney, Goshen, N.Y. (Andrew R. Kass of counsel), for respondent.

Before: Skelos, J.P., Santucci, Angiolillo, Dickerson and Chambers, JJ.

Ordered that the judgment is affirmed.

We have reviewed the record and agree with the defendant's assigned counsel that there are no nonfrivolous issues which could be raised on appeal. Counsel's application for leave to withdraw as counsel is granted ( see Anders v California, 386 US 738; People v Paige, 54 AD2d 631; cf. People v Gonzalez, Al NY2d 606 [1979]).
