Appellant Richard J. Solomonian pled nolo contendere to assault by means likely to cause great bodily injury (Pen. Code, § 245, subd. (a)(1)) and to committing his crime for the purpose of a criminal street gang (Pen. Code, § 186.22, subd. (b)(1)). Solomonian also admitted an allegation he caused the victim great bodily injury (Pen. Code, § 12022.7, subd. (a)). Pursuant to the plea agreement, the trial court imposed a four-year prison term on the assault plus three years for the great bodily injury enhancement for a total term of seven years. Solomonians three-year sentence on the criminal street gang conviction was imposed concurrently to his prison sentence. The court granted Solomonian applicable custody credits and ordered Solomonian to pay a restitution fine.
Solomonians appointed appellate counsel has filed an opening brief which summarizes the pertinent facts, raises no issues, and requests this court independently to review the record. (People v . Wende (1979) 25 Cal.3d 436, 158 Cal. Rptr. 839, 600 P.2d 1071.) The opening brief also includes the declaration of appellate counsel indicating that Solomonian was advised he could file his own brief with this court. By letter of January 3, 2003, we invited Solomonian to submit additional briefing. To date, he has not done so.
After independent review of the record, we have concluded no other reasonably arguable legal or factual argument exists.
