Defendant having moved for leave to appeal from the judgments of Seneca County Court, rendered September 16, 2013,

Now, upon reading and filing the affidavit of Mark Snyder sworn to November 29, 2014, the notice of motion with proof of service thereof, the affirmation of Barry L. Porsch, Esq. dated December 15, 2014, and due deliberation having been had thereon,

It is hereby ORDERED that the motion is dismissed and,

It is further ORDERED the ordering paragraph of the order of this Court entered November 18, 2014 is hereby amended by striking therefrom the date December 18, 2014 and inserting in place thereof the date January 22, 2015.

Memorandum: The judgments of Seneca County Court rendered on September 16, 2013 are appealable as of right if the notice of appeal is filed and served on or before January 22, 2015.
