An appeal having been taken to this Court by the defendant from a judgment of the Supreme Court, New York County, rendered on or about July 15, 2015, under indictment numbers 4352/09 and 36/10,
And a Certificate by a Justice of this Court having been entered on January 21, 2020 (M-8338), inter alia, granting defendant leave to appeal from an order of the Supreme Court, New York County, entered on or about July 3, 2019, which denied CPL 440 relief,
And an order of this Court having been entered on October 22, 2020 (M-2975), inter alia, granting defendant-appellant leave to file a pro se supplemental brief on the consolidated appeals for the April 2021 Term of this Court,
And defendant having moved for an extension of time within which to file his pro se supplemental brief and for an order directing the People to provide defendant with the minutes of the Grand Jury proceedings, including the legal instructions and charges given to the Grand Jury members, as well as the minutes of the trial proceedings held on August 16, 2010,
Now, upon reading and filing the papers with respect to the motion, and due deliberation having been had thereon,
It is ordered that the motion is granted to the extent of directing the defendant-appellant to serve and file an original and five (5) copies of his pro se supplemental brief for the October 2021 Term of this Court, to which Term the consolidated appeals are adjourned, and is otherwise denied.
