Motion No: 2018-00592 SCR

12-14-2020

The People of the State of New York, Respondent, v. Laura A. Smith, Appellant.

BRUCE E. TOLBERT

TERRY JANE RUDERMAN, JJ.

DECISION & ORDER ON MOTION

On the court's own motion, it is

ORDERED that this appeal from judgments of conviction of the District Court of Suffolk County, Suffolk County Traffic and Parking Violations Agency, rendered January 23, 2018, is stricken from the appeals calendar, and the briefs shall be returned to the parties, as the appeal has not been properly perfected. Appellant seeks review of an order dated December 11, 2017 which decided his motion for various relief and, while the order references reply papers and oral argument, neither the reply papers nor the minutes of the oral argument have been made part of the record on appeal. Appellant, if he be so advised, may move in the District Court to reconstruct the missing portions of the record.
